Prepare Tax-return form optimally — what landlords need to know about the tax return

The Tax-return form is part of the annual income tax return and records income from letting and leasing per §21 EStG. It must also be completed if the rental produces a loss — because only then can you offset the loss with other types of income and save taxes.

Typical income-related expenses you can claim in Tax-return form: maintenance expenses (repairs under €4,000, immediately deductible), construction expenses (spread over the useful life as depreciation), mortgage interest (not principal!), property management, insurance, waste collection (insofar as not allocatable), property tax (insofar as not passed on), and renovations before rental.

Important: maintenance vs. capital expenditure. Repairs up to 4.000 € net per measure are immediately deductible. Value-enhancing works such as new bathrooms or roofs count as capital expenditure and are depreciated over their useful life (typically 50 years for residential buildings).
