What must be kept?

As a landlord you are, for tax purposes, an entrepreneur within the meaning of §238 HGB. This means: HMRC + HMRC oblige you to 10-year retention of all business-relevant receipts:

  • Tenancy agreements (originals + all addenda)
  • Service-charge statements + underlying receipts (heating oil, electricity, water, caretaker)
  • Rent-payment records (bank statements, receipts)
  • Reminders, debt-collection letters, eviction claims
  • Handover protocols (move-in + move-out)
  • Repair invoices + tradesperson receipts
  • Insurance policies + policy amendments
  • Tax-relevant correspondence (tax office, tax adviser)
  • Landlord confirmations of residence

Note: the 10-year period begins at the end of the calendar year in which the receipt was created. A receipt from 2026 must therefore be kept until 31.12.2036.

What HMRC specifically requires

The "Principles for the proper keeping and retention of books, records and documents in electronic form and for data access" (HMRC for short) require:

  • Immutability — once a receipt has been filed, it may no longer be altered
  • Completeness — all relevant receipts must be captured
  • Traceability — who added/changed what and when?
  • Machine readability — during a tax audit the tax office must be able to search the records

HMRC-compliant digital archiving — how to do it right

Step 1: capture. On receiving a receipt: take a photo with your phone + generate a hash (SHA-256). The hash is the evidential trail that nothing has been altered.

Step 2: classification. Which receipt type? Which property? Which tenant? Which tax year? AI helps automatically.

Step 3: retention. At least 2 cloud backups (e.g. main provider + automatic mirroring). AES-256 encryption at rest.

Step 4: audit log. Every action (upload, view, download) is logged with date, user and hash. Proof of immutability.

Step 5: export. On a tax-audit request: all relevant receipts within minutes as a structured ZIP export.

What penalties apply for breaches

  • Estimates instead of income-related expenses — the tax office applies an estimated value, usually lower than the actual one
  • Delay of the tax refund — where receipts are missing, reclaims are possible
  • Fine for wilful neglect — up to 25,000 € (§379 AO)
  • In extreme cases: suspicion of tax evasion (§370 of the German Fiscal Code, AO) where receipts are systematically destroyed
