WEG management — what ownersneed to know in 2026
Do you own a freehold flat in a WEG (community of flat owners) and let it out? The 2020 WEG reform changed a lot. We explain the obligations, the annual meeting, quorum and what landlords in particular need to watch out for.
What is a WEG?
As soon as a building is divided into residential + separate ownership an owners' association (WEG) is formed under the Condominium Act (WEG). Each owner holds:
- Private property: your specific flat (walls facing inwards, flooring, sanitary fittings)
- Co-ownership: a share of the common property (stairwell, roof, heating, garden)
Important changes from the 2020 WEG reform
- Structural alterations now only require a simple majority (previously: unanimity)
- Charging station for an electric car, fibre-optic connection, burglary protection: simplified quorum
- Appointment of the manager: 3 years' maximum contract duration
- Hausgeldabrechnung muss bis 30. Juni des Folgejahres beschlossen sein
- Online owners' meetings now possible in a legally secure way
The owners' meeting
Takes place at least once a year. Important points:
- Einladung: 3 Wochen vor Termin schriftlich
- Quorum: no majority required (since the 2020 WEG reform!)
- Stimmrecht: nach Miteigentumsanteilen (im Grundbuch)
- Minutes: must be sent within 4 weeks
- Anfechtung: binnen 1 Monat nach Beschluss
Obligations as a freehold-flat landlord
- Pay the service charge to the management on time (otherwise a reminder + forced sale is possible)
- Observe WEG resolutions (e.g. house rules, waste separation)
- For major repairs to the private property: involve the tenant
- Pass on the service-charge components to the tenant correctly (see service-charge guide)
- For special levies: inform the tenant (even if they do not pay it)
When the WEG management is poor
Common problems: late annual statements, lack of communication, excessive management fees. Options:
- Verwalter-Wechsel (Vertragsdauer beachten — max. 3 Jahre)
- Beschluss-Anfechtung bei rechtswidrigen Entscheidungen
- Self-management of the WEG (possible for small communities)
- Bring in a lawyer specialising in WEG law
